Taxation of Nonqualified Plan Distributions Incident to Divorce

When it comes to divorce and retirement planning, a distribution of plan benefits made to a former spouse by a nonqualified plan is usually taxable to the plan participant. An exception occurs if the distribution represents the spouse's community property interest in the benefits.
