North Carolina Laws Relating to Workplace Violence

A summary of North Carolina laws relating to weapons and conduct that impact workplace violence.

In North Carolina it is unlawful to carry a concealed deadly weapon, except on one's own premises. It is unlawful to carry a concealed pistol or gun, except on one's own premises or, in the case of a handgun, with a permit. The prohibition does not apply to law enforcement and military personnel.

It is unlawful to possess or carry, whether openly or concealed, any gun, rifle, pistol or other firearm of any kind, or any dynamite cartridge, bomb, grenade, mine or powerful explosive, on educational property. Educational property includes any private or public school building, bus, campus, grounds, recreational area, athletic field or other property owned, used or operated by any board of education, school, college or university board of trustees or directors for the administration of any public or private educational institution.

It is also unlawful to carry any gun, rifle or pistol into any assembly for which a fee has been charged for admission or into any establishment in which alcoholic beverages are sold and consumed. In addition, it is unlawful for any person to possess or carry, whether openly or concealed, any deadly weapon, not being used solely for instructional or officially sanctioned ceremonial purposes, in the state capitol building, the executive mansion, the western residence of the governor or on the grounds of any of these buildings and in any building housing any court of the general court of justice. If a court is housed in a building containing nonpublic uses in addition to the court, the prohibition applies only to that part of the building used for court purposes while being used for court purposes.

This prohibition does not apply to state-owned rest areas, rest stops along the highways and state-owned hunting and fishing reservations.

A person is not authorized to carry a concealed handgun in a legally prohibited area, including government offices, financial institutions and premises where notice that carrying a concealed handgun is prohibited are posted, even with a permit.

Additionally, with or without a permit, it is unlawful for a person to carry a concealed weapon while under the influence of alcohol or non-prescribed controlled substances.
